Animals rescued from cruelty often carry deep physical and psychological scars. Some arrive in shelters after severe neglect. Others have lived through fear, intimidation, pain, or deprivation. These animals need safety, treatment, and a real chance to recover, not a system that allows convicted abusers to obtain more pets with little resistance.12

Too Many Animals Remain At Risk

Animal cruelty cases already strain shelters, rescues, investigators, and communities. The ASPCA has warned that cruelty victims can remain in legal limbo for long periods while agencies absorb the cost of care and recovery.1 At the same time, experts recognize that some forms of cruelty, especially repeated or serious abuse, call for stronger safeguards to prevent future harm.3

Restrictions on animal access after conviction can help break that cycle. The MSPCA has supported measures that prevent convicted offenders from owning, possessing, adopting, or fostering animals for a court-ordered period.4 That principle should not depend on zip code.

Federal Action Can Close A Dangerous Gap

Right now, protections vary too widely. A person convicted of abusing an animal may still be able to seek another pet through a shelter, rescue, breeder, or private sale. That leaves more animals exposed to avoidable suffering.

Congress has the power to pass a federal law that bars convicted animal abusers from adopting, fostering, buying, or otherwise obtaining companion animals nationwide, and USDA APHIS should help support strong enforcement and practical screening standards that keep animals safer.

The Petition

To Members of the United States Congress and the U.S. Department of Agriculture’s Animal and Plant Health Inspection Service,

I am writing to urge you to pass federal legislation that bans convicted animal abusers from adopting, fostering, purchasing, or otherwise obtaining pets for a meaningful period of time.

Animals who survive cruelty and neglect often face lasting trauma. Many need medical care, behavioral support, and a stable home before they can begin to recover. Yet despite the seriousness of these crimes, gaps in the law still allow some offenders to return to shelters, rescues, breeders, or private sales and obtain more animals. That failure puts more vulnerable lives at risk.

A cruelty conviction should carry consequences that protect future victims. When someone has already been found responsible for abuse, the burden should not fall on shelters, rescue groups, or unsuspecting communities to hope that person will not offend again. Federal law should create a clear, enforceable barrier.

I ask Congress to enact legislation that does the following:

  • Prohibits convicted animal abusers from adopting, fostering, purchasing, or otherwise acquiring companion animals for a court-ordered period.
  • Requires practical screening tools so shelters, rescues, breeders, and sellers can identify disqualified applicants.
  • Supports enforcement and information-sharing so protections do not vary wildly from one state to another.
  • Recognizes that animal cruelty is a serious public concern that demands prevention, accountability, and compassion.

This is not a call for cruelty victims to remain trapped in legal systems that move too slowly. It is a call for humane, preventive action that places animal safety first. Our laws should reflect a basic principle: those who have abused animals should not be trusted with new ones.

Animals cannot speak for themselves when they are frightened, isolated, or hurt. We can. We can choose a legal standard that treats their safety as a priority instead of an afterthought.

Please act to close this dangerous gap and protect animals from repeat harm. These actions will ensure a better future for all.
